Terms of Service

1. Agreement to Terms

By accessing or using LobsterLair ("Service"), operated by Banalabs ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

LobsterLair provides managed hosting for OpenClaw, an open-source AI agent framework. Your subscription includes access to our AI model (currently MiniMax M2.7), so you can start chatting without providing your own API keys. We handle infrastructure, AI provisioning, security, and updates.

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account.
  • You must be at least 16 years old to use this Service.
  • One person or entity may not maintain more than one account.

4. Subscription and Payment

  • The Service costs $19 per month, billed monthly upfront through Stripe.
  • A container is only provisioned after the first successful payment.
  • Subscriptions renew automatically each month unless cancelled.
  • You can cancel at any time from your dashboard; your bot continues to run until the end of the paid billing period.
  • No refunds are provided for partial months.

5. Your Responsibilities

You are responsible for:

  • The content generated by your bot and how it is used.
  • All activities that occur under your account or within your bot's container, including scripts, tools, and network connections initiated by your bot.
  • Complying with all applicable laws regarding AI-generated content and computer access.
  • Keeping your account credentials and bot tokens secure.
  • Any third-party API keys you optionally add to your bot configuration.
  • Ensuring your bot does not generate content or perform actions that violate these terms or applicable law.
  • Ensuring that any tools, scripts, or skills you install or run within your bot's environment are used lawfully and ethically.

6. Acceptable Use

You agree NOT to use the Service to:

  • Violate any laws or regulations.
  • Generate illegal, harmful, abusive, or deceptive content.
  • Spam, harass, or harm others.
  • Attempt to gain unauthorized access to our systems or any third-party systems, networks, or services.
  • Scan, probe, or test the vulnerability of any system or network, or breach any security or authentication measures, whether targeting our infrastructure or external targets.
  • Harvest, collect, or store credentials, API keys, tokens, passwords, or other authentication material belonging to third parties.
  • Use the Service as infrastructure for attacks against third parties, including but not limited to port scanning, credential stuffing, brute-force attacks, denial-of-service, or automated reconnaissance.
  • Run scripts, bots, or automated tools designed to scrape, exploit, or compromise third-party services or data.
  • Use stolen, leaked, or unauthorized credentials or API keys through the Service.
  • Interfere with or disrupt the Service.
  • Resell or redistribute the Service without permission.
  • Circumvent any usage limits or fair use policies.
  • Use the AI to generate content that impersonates real people without their consent.
  • Use the Service in any way that could damage our reputation, get our infrastructure blacklisted, or expose us to legal liability.

7. Included AI & Fair Use Policy

Your subscription includes access to our AI model at no additional cost, subject to the following fair use policy:

  • AI usage is intended for personal or small-business chatbot use — conversations with real users at a normal, human pace.
  • Automated bulk requests, scripted message flooding, stress testing, or any form of programmatic abuse of the AI is prohibited.
  • Using the Service primarily to extract, proxy, or resell AI model access to third parties is prohibited.
  • Running excessive automated cron jobs or scheduled tasks that generate high volumes of AI requests without genuine user interaction is not permitted.
  • We reserve the right to monitor aggregate usage patterns (not message content) to detect abuse.
  • If your usage significantly exceeds normal patterns, we will contact you before taking any action. Continued excessive use after notice may result in throttling or account suspension.
  • We may change the included AI model or usage limits at any time, with reasonable notice to active subscribers.

8. Service Availability

We strive to maintain 24/7 uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

9. OpenClaw Software

LobsterLair hosts OpenClaw, which is open-source software developed by the OpenClaw community. We are not affiliated with the OpenClaw project. We run the original, unmodified software and review updates for security before deployment.

10. Data and Privacy

  • Your data is handled according to our Privacy Policy.
  • API keys are encrypted with AES-256-GCM.
  • Each bot runs in an isolated container.
  • You can export your data at any time.
  • Data is retained for 30 days after subscription ends.

11. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your subscription at any time. Upon termination:

  • Your bot will stop running immediately.
  • Your data will be retained for 30 days.
  • After 30 days, all data will be permanently deleted.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BANALABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by updating the "Last updated" date and posting a notice. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.
